At only 17 years old, Kyle Bachus won his first argument in front of the state supreme court.

Kyle, a junior in high school at the time, participated in Florida state legislation day for high school students. As part of the day’s events, he was chosen to argue a set topic in front of a board of real lawyers sitting on an imitation supreme court. After he received the necessary documentation, his task was to study it and formulate a comprehensive argument. He was surprised and inspired to be selected as one of the best presenters of the day statewide.

There was no stopping him once he decided on a career in law. His opponents see the same determination in him today that he nurtured in college, where he dedicated himself to excelling. After earning his Juris Doctor degree from the University of Florida College of Law, he immediately started work at a plaintiff’s personal injury law firm. It was perfect for him because he had always been sympathetic to those who are disadvantaged.

In 1994, Kyle moved from his home state to Colorado. He soon found a job at a Denver personal injury law firm. With only a rented office and immense dedication, Kyle & Darin Schanker opened Bachus & Schanker, LLC. From less than $15,000 humble beginnings, their business has morphed into one of the biggest and most reputable personal injury companies in the area. Kyle has years of experience fighting for justice on behalf of his clients. One of the most inspiring wins is helping emergency medical responders who suffered disabling injuries in the 9/11attacks. Out of the good individuals in this world, Kyle didn’t think twice about being one of them. He was one of only two attorneys in Colorado who would be providing pro bono legal services to help victims and their families get through something devastating. And not to mention, he had to pay for his own travel expenses. This act touched many people across the nation as part of the national Trial Lawyers Care program.

He has also worked on state and national legislation to protect Colorado consumers. Kyle learned early that to battle against unfairness, it is best to comprehend the rules and legal principles that control our society. He has utilized his deep understanding to help change state laws for the betterment of all Colorado residents.

COLORADO LEGAL EXPERIENCE

Kyle was heavily involved in drafting Colorado House Bill 10-1168, which is also known as the Make Whole bill. The bill was signed into law in May 2010. This bill shields injury victims from having to refund health insurance plans for various medical bills using their personal injury settlements. This law benefits innocent victims who were hurt because of another person or organization’s deliberate wrongfulness or carelessness. The Make Whole doctrine necessitates that the injured individual is completely compensated or “made whole” before the health insurance company can request subrogation or reimbursement.

Moreover, Kyle played a pivotal role in the creation and implementation of a crucial amendment to Colorado’s Uninsured Motorist Statute, Colorado Revised Statute 10-4-609. The amendment went into effect on January 1st, 2008. Kyle’s initial amendment would have a major impact on “safety net” insurance coverage for people who are injured by an uninsured or under-insured driver. The Amendment prevents insurance companies from denying consumers the full benefits they thought they were buying when purchasing UM/UIM coverage in Colorado. This change affects every UM/UIM automobile insurance policy issued or renewed in Colorado on or after Jan. 1, 2008.

Kyle is not only active in several professional organizations, but he has also received high marks from both his peers and those he has represented in industry publications. He is frequently asked to speak and lecture on legal topics.

Kyle has served as the co-chair of the Colorado Trial Lawyers Association Auto Litigation Committee since 2005 and remains in that position today. The national legal publication Lawdragon has named him one of “The Top 500 Leading Personal Injury Lawyers in America.” Kyle has been on the list of Colorado Super Lawyers since 2007 and was also recently noted as one of “Colorado’s Top Lawyers” in plaintiff’s personal injury law. In 2013, he led the Bachus & Shanker, LLC trial team to achieve the biggest personal injury verdict in all of Colorado that year. Moreover, in 2014 Kyle was appointed Top Class Action Lawyer in Colorado by Law Week.
